Use of the website and purchase of products imply acceptance of these General Terms and Conditions of Sale.
2. Products
Tenuta Marengo sells:
- 75 cl bottled wines;
- bulk wines packed in bag-in-box;
- other wine products possibly available in the online catalogue.
Photographs are for illustrative purposes. Any differences in label, vintage or packaging that do not alter the product’s characteristics do not constitute a defect.
3. Sale of alcoholic beverages
The sale of alcoholic beverages is permitted exclusively to persons who have reached 18 years of age.
By placing an order, the customer declares that they are of legal age.
Tenuta Marengo reserves the right to cancel orders should non-compliance with this requirement emerge.
4. Prices
All prices are expressed in Euro (€) and include VAT where applicable.
Shipping costs are calculated during the purchase process and shown before order confirmation.
Tenuta Marengo reserves the right to change prices at any time. Changes will not affect orders already confirmed.
5. Purchase procedure
The customer may purchase products by following the procedure on the website.
The order is considered completed only after Tenuta Marengo sends its confirmation.
The company reserves the right to refuse incomplete or abnormal orders, or orders for which payment has not been authorised.
6. Payment methods
The following payment methods are accepted:
- Credit/debit card via Nexi;
- Credit/debit card via Stripe;
- Advance bank transfer;
- Cash on delivery (where available);
- Collection at the premises with payment according to the agreed methods.
The order will be processed after payment confirmation, except in the case of cash on delivery.
7. Shipping and delivery
Shipments are made via selected national couriers.
Delivery times are indicative and normally between 2 and 5 working days within the national territory, excluding islands, remote areas or events of force majeure.
Shipping costs are calculated based on the order weight, destination and number of parcels.
Upon delivery, the customer must check the integrity of the packaging.
In the presence of obvious damage, it is necessary to accept the parcel with reservation and notify Tenuta Marengo within 48 hours by sending photographs of the parcel and the product.
8. Product availability
Products are available while stocks last.
In the event of unavailability after the order, the customer will be promptly informed and may choose between:
- refund;
- product replacement;
- waiting for new stock.
9. Right of withdrawal
Pursuant to Art. 59 of Legislative Decree 206/2005 (Consumer Code), the right of withdrawal may be excluded in the cases provided by law, in particular for food goods that risk deteriorating or expiring rapidly.
The application of current legislation on defective or non-conforming products remains unaffected.
10. Damaged products
Any products damaged during transport must be reported within 48 hours of delivery by sending:
- order number;
- description of the issue;
- photographs of the product;
- photographs of the packaging.
After the necessary checks, Tenuta Marengo will, where due, replace the product or issue a refund.
11. Liability
Tenuta Marengo is not liable for delays attributable to couriers, weather events, strikes, force majeure or other circumstances not directly dependent on its organisation.
12. Intellectual property
All website content, including images, photographs, texts, trademarks, logos and graphics, is the property of Tenuta Marengo or the respective owners and is protected by applicable law.
Any reproduction without authorisation is prohibited.
13. Privacy
Personal data are processed in compliance with Regulation (EU) 2016/679 (GDPR) and as indicated in the Privacy Policy published on the website.
14. Applicable law
These General Terms and Conditions are governed by Italian law.
For any dispute, the Court having jurisdiction under the applicable consumer protection rules shall be competent. For disputes with parties who do not qualify as consumers, the jurisdiction rules set out in the Code of Civil Procedure shall apply.
